Congress Takes First Major Step Toward Federal AI Regulation: A Fierce Debate Over Innovation, Control, and Consumer Protection Unfolds
In a pivotal moment for American technology policy, Congress has begun seriously considering the first-ever federal regulations on artificial intelligence. This week, the House Subcommittee on Innovation, Data, and Commerce convened a two-and-a-half-hour hearing that marked a turning point in the national conversation around AI governance—and the stakes couldn’t be higher.
At the heart of the discussion was a fundamental question: Can Congress craft a balanced framework for AI that keeps America competitive without compromising safety, ethics, and consumer protection?
The Global Race for AI Leadership
“We're here today to determine how Congress can support the growth of an industry that is key for American competitiveness and jobs—without losing the race to write the global AI rule book,” declared Rep. Gus Bilirakis (R-FL), the subcommittee’s chairman.
Global pressure is building. The European Union’s comprehensive AI Act went into effect last year, setting strict compliance requirements on AI developers. Meanwhile, China continues to ramp up its AI infrastructure, gaining ground on the U.S. in computing power and research breakthroughs.
Marc Bhargava, a director at global venture capital firm General Catalyst, testified that the U.S. still holds the top position globally in AI innovation, but warned that “China is right behind us.” The EU’s approach, he noted, while well-intentioned, risks overburdening startups and slowing innovation.
A Push to Halt State-Level AI Laws
One of the most controversial proposals discussed at the hearing was a Republican-backed effort to halt state-level AI legislation for the next decade. This proposed moratorium was quietly advanced last week as part of a broader House Energy & Commerce Committee budget plan.
Proponents argue that the moratorium is necessary to give Congress time to develop a national AI framework that avoids a patchwork of conflicting state laws. More than 1,000 state-level AI bills have already been introduced in 2025 alone, creating what Rep. Jay Obernolte (R-CA) called “regulatory chaos.”
“The states got out ahead of this,” Obernolte said. “They feel a creative ownership over their frameworks, and they're the ones that are preventing us from doing this now. Which is an object lesson for why we need a moratorium.”
Critics Say Moratorium Favors Big Tech
But not everyone agrees. Rep. Kim Schrier (D-WA) slammed the proposed moratorium as a giveaway to tech giants like Meta and Google, claiming it would weaken protections for consumers without offering a federal solution in return.
“This is Republicans’ big gift to big tech,” Schrier said. “Instead, we should be learning from the work our state and local counterparts are doing now to deliver well-considered, robust legislation. American businesses need a clear framework to succeed—but not at the expense of consumer safety.”
Rep. Kathy Castor (D-FL) added a deeply emotional angle to the debate. She shared stories of minors in her district who were negatively affected by AI-driven interactions with chatbots, including one tragic case involving suicide.
“What the heck is Congress doing?” Castor exclaimed. “You’re taking the cops off the beat while the states are trying to protect people.”
Industry Voices Warn Against Overregulation
Despite the heated political back-and-forth, most voices agreed on one point: AI is too important to remain unregulated, but also too delicate to be overregulated.
Bhargava emphasized the need for balance. “The reason we're ahead today is our startups,” he said. “We have to think about how to continue to give them that edge. That means guidelines—not a patchwork of overregulation.”
He described how many VC firms and AI companies already practice responsible self-governance, evaluating datasets, training models, and potential harms of AI systems as part of due diligence. But Bhargava also acknowledged that this approach is uneven across the industry and that a federal framework would provide much-needed consistency.
Sean Heather from the U.S. Chamber of Commerce also warned that adopting a regulatory approach too similar to the EU’s could “bump the U.S. out of its top position” in global AI leadership.
Who Should Set the Rules?
Amba Kak, co-executive director of the AI Now Institute, pushed back on the idea that the industry should be left to self-regulate. She argued that existing federal laws are insufficient to manage the rapidly evolving risks of AI, particularly when it comes to children, disinformation, and biometric surveillance.
“If the current system worked, we wouldn’t be seeing AI systems that exploit children and mislead consumers,” Kak said. “Self-regulation has already failed in other industries. AI should be no exception.”
A Call for Bipartisanship
Bhargava concluded his testimony by urging lawmakers to build on last year’s findings from the Bipartisan House Task Force on Artificial Intelligence. Released in December, the Task Force’s report laid out recommendations for safety, innovation, international competitiveness, and ethical use.
“I strongly encourage you to work together on a bipartisan framework,” Bhargava said. “If we can turn this into real policy—federal policy—we’ll be giving American startups and consumers the clear rules they deserve.”
